GlueStick End User License Agreement

1. ACCEPTANCE OF TERMS

By downloading, installing, or using the GlueStick mobile application ("App"), you agree to be bound by this End User License Agreement ("Agreement"). If you do not agree to these terms, do not use the App.

2. LICENSE GRANT

GlueStick LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with this Agreement.

3. SUBSCRIPTION AND PAYMENTS

3.1. The App offers three subscription tiers:

- Monthly subscription: $10/month

- Annual subscription: $79/year

- Lifetime subscription: $199 (one-time payment only available to early app adopters)

3.2. Each subscription includes:

• Unlimited user profiles

• One household supply list

• Ad-free access to all tutorials and features

• Access to the Art Gallery and project sharing capabilities

• Avatar customization features

• Access to AI-generated features

• AI-powered supply recognition technology

• AI-powered MakerBot Creative Prompts

3.3. School Fundraising Program

GlueStick partners with PTOs, PTAs, and other school organizations through a fundraising program. Donations are processed according to the terms agreed upon with each participating organization. Users must enter the unique school code for their purchase to be credited to their school’s donation program.

4. CONTENT AND INTELLECTUAL PROPERTY

4.1. All content, including but not limited to tutorials, artwork, graphics, and text, is protected by copyright and owned by GlueStick LLC or its content partners.

4.2. User-Generated Content: - You retain ownership of content you create using the App - By sharing content in the Art Gallery, you grant GlueStick a non-exclusive license to display and share your content within the App

4.3. Content Partner Materials: -

• Content provided by partners is subject to revenue-sharing licensing agreements. Our standard licensing agreement can be found at https://www.gluestick.app/licensing-agreement.

• Users may not reproduce or distribute partner content outside the App

5. PRIVACY AND DATA PROTECTION

5.1. The App is COPPA-compliant and implements industry-standard security measures to protect user data.

5.2. User data collection and usage are governed by our Privacy Policy, available at www.gluestick.app/privacy.

6. ACCEPTABLE USE

6.1. Users agree to:

• Use the App for its intended purpose of family creative activities

• Follow safety guidelines provided in tutorials

• Respect intellectual property rights

• Maintain appropriate conduct in the Art Gallery

6.2. Users shall not:

• Reverse engineer or modify the App

• Use the App for commercial purposes

• Share account credentials

• Upload inappropriate or harmful content

7. CONTENT MODERATION

GlueStick reserves the right to:

• Review and moderate all shared content

• Remove content that violates guidelines

• Suspend or terminate accounts for violations

8. ARTIFICIAL INTELLIGENCE FEATURES

8.1. The App incorporates artificial intelligence technology, including but not limited to:

• Supply image recognition

• Project recommendations

• Content customization

8.2. AI Feature Usage:

• AI features are provided "as is" and may be modified or removed

• Users acknowledge that AI recognition results may vary

• Users agree not to attempt to deceive or manipulate AI systems

• GlueStick is not liable for AI feature accuracy or availability

8.3. AI Data Collection:

• User interactions with AI features may be collected to improve services

• Image data processed by AI features is handled in accordance with our Privacy Policy

• Users retain ownership of images submitted for AI processing

8.4 Limits on AI Feature Usage:

GlueStick reserves the right to establish and modify usage limits based on typical user patterns. Users will be notified of any specific usage limitations once established. GlueStick may temporarily restrict access if unusual usage patterns are detected or if fraud is suspected.

9. WARRANTY DISCLAIMER

The App is provided "as is" without warranties of any kind, either express or implied.

10. LIMITATION OF LIABILITY

GlueStick LLC shall not be liable for any indirect, incidental, special, or consequential damages caused by using the app or completing project tutorials found within it.

11. DISPUTE RESOLUTION

Any disputes shall be resolved through arbitration in accordance with the laws of the State of Minnesota.

12. COPYRIGHT COMPLAINTS

Copyright violations can be reported at https://www.gluestick.app/content-inquiry for investigation and resolution.

13. MODIFICATIONS TO SERVICE

GlueStick reserves the right to modify or discontinue the App or any feature at any time with reasonable notice to users.

15. UPDATES TO THIS AGREEMENT
